Seminar on “The Belt & Road Seminar - Legal Challenges of Applying AI”

Maritime Silk Road Society (MSRS) organized a seminar on “The Belt & Road Seminar - Legal Challenges of Applying Artificial Intelligence” on 24 June. Mr Anthony Tong, Solicitor, Managing Partner at Robin Bridge & John Liu was the speaker.
Firstly, Mr Tong raised the challenges and difficulties in the use of Artificial Intelligence (AI). One of the challenges and difficulties is confidentiality as the handling of personal data requires special attention. He cited several examples of misuse in the past and pointed out the existing security vulnerabilities of AI. Another one is on liability. Mr Tong pointed out that we should pay attention to the terms and conditions of the AI service providers which should clearly indicate the attribution of legal liabilities and the risks of use.
He gave an overview of the regulatory regimes of AI around the world and illustrated with litigation cases. For example, there are copyright disputes over images generated by AI and whether there is any infringement of copyright in the datasets used to train the AI.
Secondly, Mr Tong specified the key points to be considered in dealing with AI infringement. The legitimacy of the source of the data, the availability of exceptions to infringement and the purpose of use should all be examined.
In his view, the legal challenges of applying AI under the “Belt and Road” framework are even more complex. Laws vary from country to country due to the difference in history, culture and religion and there is a need for consensus and balance. Mr Tong said that China is now in the process of updating the Implementing Regulations of its Copyright Law which will hopefully provide definitive guidance on subsistence and ownership of AI Generated Works. He encouraged the public to seriously ponder whether Hong Kong can align its AI policy with China and ultimately complement each other.
